Supreme Court Justice John Paul Stevens says he “will surely” retire while President Barack Obama is still in office, giving the president the opportunity to maintain the high court’s ideological balance.
“I will surely do it while he’s still president,” Stevens told The Washington Post.
Can we all stop pretending that SCOTUS is independent of politics? It’s war, time to gear up for a good fight. While we are busy saying “Nancy is nice” don’t think that the radical left wouldn’t want to have the entire court all liberals if they could. Don’t lay down on this one. Especially since Steven’s was nominated by Gerald Ford. Gee thanks Justice Stevens.
Stevens said last week that he thought the country had collapsed into troubling political divisions. “There is more polarization than there used to be, and I don’t think that’s a good thing. I definitely don’t.”
Gee, not like you announcing you’ll retire for sure when Obama is in office, no division or partisanship there, eh?
Steven’s made it official today. Hopefully that is a sign from the high court that Obama is a one term disaster and not an 8 year nightmare for America.

Really, I think this is
drohan00 (Diary) Friday, April 9th at 12:17PM EST (link)because Stevens wants Obama to get someone confirmed while the Democrats have 59 seats still in the senate. RealClearPolitics is showing a +6 to +8 gain for the GOP in November in the Senate. That will not be an environment where the Democrats can easily get anything through the Senate.
Stevens thinks this will be easier this year. Except, because of the cases before the SCOTUS, it will be tough this election year. A lot of hurting Democrats will be loathe to vote for a nominee not give a modicum of clearance by the NRA.
Republicans will make hay with whomever Obama appoints, and I think the chance of a bi-partisan filibuster of someone like Elena Kagan is definitely possible. This will be the last hurrah for the so-called Blue-Dogs in the Senate to oppose a liberal Democrat position. This will allow them to re-assert themselves, which they need after the healthcare vote.
The GOP Should Plan on Filibustering All Scotus Nominees Through December as a Matter of Course
IJB Friday, April 9th at 12:37PM EST (link)I’m assuming that Obama will fail to be clever and nominate a “Breyer-esque” moderate. That means it’s imperative that the Senate GOP drag this nomination fight out through (and beyond) the November election.
Running out the clock until the next Congress, when the GOP is likely to have at least 47 or 48 Senators and when we can then *force* Obama to pull the lib nominee and replace him with a moderate, must be THE GOAL.
Forcing Obama to replace Stevens with a relative “moderate” like Breyer would be a massive victory for conservatives, the GOP, and the country.
SCOTUS JPS letter to Obama: "My dear Mr. President"
Common_Cents (Diary) Saturday, April 10th at 12:22PM EST (link)Oh Dear Leader!
Are you kidding me?
Let’s blow this stupid elephant in the room notion that the SCOTUS is some high independent body. The SCOTUS will be a new tool for the left to co-opt just like the media. This guy was a supposed conservative and appointed by Ford. But the left claims him as their own and “we must play nice” and let them get another liberal.
“My dear Mr. President”?
“My dear Mr. President:
Having concluded that it would be in the best
interests of the Court to have my successor appointed
and confirmed well in advance of the commencement of
the Court’s next Term, I shall retire from regular
active service as an Associate Justice, under the
provisions of 28 D.S.C. § 371(b), effective the next
day after the Court rises for the summer recess this
year.
Most respectfully yours,
John Paul Stevens”
