Obama’s Justice Department goes New York Times and reveals secret Bush Administration legal advice.
President Obama’s Attorney General today released previously undisclosed legal memoranda and opinions that the Bush Administration considered secret.
Attorney General Eric Holder tried to justify the revelation of the confidential legal advice as serving the interests of transparency:
“Americans deserve a government that operates with transparency and openness,” said Attorney General Eric Holder.
If this wasn’t such serious issue, it would be funny coming as it does from an administration that throws promised transparency under the bus when Obama finds it politically expedient.
I haven’t had time to digest these formerly secret documents, but releasing the confidential legal advice of the Bush Administration can only make it less likely that the new and not ready for prime time Obama Administration will not get the candid legal advice that it will need. Attorneys writing opinions and memoranda for Obama will now have to keep in mind how the advice will read in the New York Times. Some officials may now be reluctant to seek advice from Attorney General out of fear that their communications will be revealed to others.
Maybe I will feel better about this after reviewing the formerly secret documents. But now Holder’s “transparency” seems like a first step toward that political retribution dressed up as investigations of the looney left-wing’s fanciful allegations of Bush administration war-crimes. You know, those things Obama promised to have his Attorney General investigate, and about which Holder has already made up his mind.
The documents revealed by Holder are linked below:

DONTREADONME (Diary) Monday, March 2nd at 9:35PM EST (link)Remember, Mr Obama, you have now set precedence for the next adminsitration to release all and every document they see fit in the terms of keeping with a Government of transparency. Heh, Mr Obama, why dont we give up our missile defense specificaions that are top secret, oh wait you are about to do that. Maybe we should give Iran the schematics for our Thermonuclear devices 10MegaTon sizes shall do but heh, all in the keeping of transparency. Now who are those CIA agents in truly difficult spots, well in keeping with transparency why do we not release those names. Hell, let us release all Top Secret and Secret information to the New York Times in keeping with this no sense of openness in a Government. Mr. Zero and Mr Cant Holder you are the enemy’s of the state if you continue down this road. Keep it up.

I’m nervous the change they want to make to the constitution to have all senators elected, instead of selected, is a red herring to get the repeal of term limits past the required number of states. In other words.. I don’t trust this administration, this senate, this congress.

So Bush was Seeking Legal Advice
JX12 (Diary) Monday, March 2nd at 10:36PM EST (link)Good. Bush should have been doing something to cover himself in the event he was accused of doing what every wartime President worth his salt has done anyway. Why this is supposed to make Bush look bad is beyond me.
In fact, this action says far more about Obama than it does about Bush. This is absolutely unconscionable. I never thought I would publicly say that the American electorate was completely out of its collective mind in November; but the truth is the truth. It was.
Will the Obama voters learn their lesson from something like this? Probably not today; but that day may yet come. As far down the slippery slope as this nation has been sliding over the last few decades (culminating in the election of this outrageous crop of lawmakers), it appears about the only thing that will wake people up at this point is a national cataclysm the likes of which would make 9/11 look like a Section B Page 10 afterthought of a news story – and that is a shame, because it doesn’t have to be so. However, with actions such as that carried out by this administration today, the green light has – at least subtly, if not blatantly – just been given to our enemies to do pretty much as they please. Such a cataclysm may therefore visit us sooner than we think. Will those who remain be convinced?
What an absolute flaming outrage. 2012 cannot come soon enough.

victor_cocchia (Diary) Monday, March 2nd at 11:19PM EST (link)This article (the one you linked where Obama plans to give up missile defense for assurances on Iran) Is only the tipping point of a very very very poor strategic policy towards both Russia and Iran for, and by, this adminstration.
First instead of engaging Russia from a point of strength, and working to ensure that they are not hostile to us by creating economic ties (possibly through energy policy) they are ready to abandon a missile shield that is not designed to only protect us from Iran, but other rogue states, terrorist cells that get a nuclear weapon, and possibly Russia itself, but he goes about cutting military spending, possibly abandoning the F-22 fighter jet. etc etc.
This on top of nearly $1B to Palestine, under the guise of “rebuilding” when re-arming would be a more “transparent” term
I am afraid that his foreign policy may be as bad, or worse, than his domestic policy

It’s pretty obvious from what we’ve seen so far that the Obama administration’s promised “transparency” only applies to anything that lefty groups and trial lawyers can use against Bush administration and military officials. The Obama records will be kept locked tighter than a drum, and no future Republican President would be such a low-class scumbag as to return the favor.
So Obama’s cadre of lefty lawyers can give him all the advice they want without worry.
And of course the NYT/WP/etc. won’t have truckloads of people trying to uncover any of that. What Obama administration officials do the country and the world is surely less important than oh say every email ever sent by Sarah Palin or where Bobby Jindal was every moment of Sept 2005.

This is a declaration of war on the office of the Presidency
civil truth (Diary) Tuesday, March 3rd at 1:22AM EST (link)Our system of government in which we peacefully transtion power rests on a foundation that the occupants respect those who have gone on before – respect that the American people elected them to that office – which forms a basis of trust that surrender power to the next administration is not an invitation for retribution and proscription of the former president and his party.
What Obama has done here is to breach that trust, thereby issuing a declaration that the President Bush is an “enemy of the people” and by extension the Republican party.
This is a clear sign that the Obama administration plans that it (or at least the Democratic party) will never surrender the office of the President – or that if it does, it will make the country ungovernable for the next Republican to assume that office – though my bets are on the first.
He has leaped astride upon the back of the tiger. God help us.
