Once again, Democrats are planning on doing something wrong, and once again Texas Senator Ted Cruz is moving to stand in their way.

Neither Joe Biden nor Kamala Harris would flat out deny that they would ever try to pack the Supreme Court which means that the likelihood of them doing is relatively high. Adding judges to the nine currently sitting on the bench in order to give Democrats a constructionist advantage in the highest court in the land.

Cruz, joined by five other Republicans, have a solution to this problem and it’s stopping Democrats cold by using the document that has been stopping Democrats cold for generations.

According to The Hill, Cruz and his team of Republicans have introduced a constitutional amendment that would prevent Biden from expanding the court and putting in his own justices.

The language is very simple and clear cut so that it can’t be misinterpreted: “The Supreme Court of the United States shall be composed of nine justices.”

While this is a great idea, passing a constitutional amendment is no easy feat. It would need to pass with a supermajority in the Senate and the House in order to be ratified. On top of that 38 of the 50 states will need to approve of it as well.

“Make no mistake, if Democrats win the election, they will end the filibuster and pack the Supreme Court, expanding the number of justices to advance their radical political agenda, entrenching their power for generations, and destroying the foundations of our democratic system,” Cruz warned in a statement.

“We must take action before election day to safeguard the Supreme Court and the constitutional liberties that hang in the balance,” he added.

At this point, it’s a certainty that court-packing will happen should Biden get elected. While Biden may be dodging the question, other Democrats are being very open about their desire to pack the court. Senate Minority Leader Chuck Schumer swore that if Republicans pushed through Amy Coney Barrett through to the Supreme Court that “nothing is off the table for next year.”

Likewise, Democrat Sen. Ed Markey outright called for it to happen, saying “abolish the filibuster and expand the Supreme Court” if Senate Majority Leader Mitch McConnell went forward with Barrett.

At this time, the chances of passing an amendment are slim but this is all the more reason to vote in Republicans. Doing so would allow a limit to be put on the court and stop Democrats from corrupting it by throwing in as many justices as it takes to give them the advantage.
